Levittown resident Thomas DiNapoli was convicted on Monday, June 26, the Nassau County District Attorney announced.

DiNapoli, 70, was found guilty of murder and attempted murder over an incident in August 2020 in which he shot his wife after an argument and then tried to kill his brother-in-law.

On the night of August 13, 2020, DiNapoli and his wife, Cheryl, got into an argument in the bedroom of their Cod Lane home, the district attorney said.

During the fight, DiNapoli shot his 61-year-old wife in the eyes and neck with a 9mm rifle.

The wife’s brother, who has not been named, was living with the couple at the time and went into the bedroom after hearing the commotion.

A fight broke out between DiNapoli and his brother-in-law, who eventually wrestled the rifle from the attacker.

The brother-in-law contacted police before DiNapoli re-entered the room with another gun, this time a shotgun, which he took from a safe in the couple’s garage.

According to the district attorney, DiNapoli fired at the victim from outside the door, hitting him in the arm.

The pair got into a physical altercation throughout the house and entered the front yard, where the victim again wrested the shotgun from the attacker and police arrived.

Cheryl DiNapoli was pronounced dead at the scene. Her brother was taken to hospital and is reported to be recovering.

“Thomas DiNapoli shot his wife twice in the face with a rifle, brutally killing her,” said Nassau County District Attorney Anne T. Donnelly.

“I thank our prosecutors and police for their help in convicting this heartless defendant.”

DiNapoli’s trial began on Friday, June 16, and concluded ten days later with a jury summary and decision.

DiNapoli was found guilty in total of:

  • second degree murder
  • attempted second degree murder
  • level one attack

He will return to court for sentencing on Thursday, July 27. He could face a maximum sentence of 50 years to life in prison.
